These Terms & Conditions (“Terms”) govern your access and use of the InstaPitch mobile application (“App”) developed and operated by Nitai Technologies OPC Pvt Ltd (“Nitai”, “we”, “us”, or “our”). By accessing or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the App, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you may not access or use the App.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the App.
3. Account Creation
To access certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and password. You are also responsible for all activities that occur under your account.
4. Permissible Use
You may only use the App for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates any applicable law or regulation.
- Use the App to infringe upon the intellectual property rights of others.
- Use the App to transmit any harmful or offensive content.
- Use the App to spam or otherwise harass others.
- Attempt to gain unauthorized access to the App or any related systems.
- Use the App for any commercial purpose without our express written consent.
5. Content ownership
The content of the App, including text, graphics, images, logos, and software, is the property of Nitai or its licensors and is protected by copyright and other intellectual property laws. You may not use any of the content without our express written consent.
6. User-Generated Content
You may submit information and content to the App (“User-Generated Content”). You retain all ownership rights to your User-Generated Content. However, by submitting User-Generated Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User-Generated Content in any media format and through any media channels.
7. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.
8. Limitation of Liability
WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.
9. Termination
We may terminate your access to the App at any time, for any reason, with or without notice.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.
11. Entire Agreement
These Terms constitute the entire agreement between you and us with respect to the App and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
12. Changes to Terms
We may change these Terms at any time by posting the revised Terms on the App. Your continued use of the App after the posting of the revised Terms constitutes your acceptance of the changes.
